Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Blu application and Blu electric bicycle rental services ("Services"). By creating an account, unlocking a BluBike, or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.

1. Definitions

"Blu" refers to Blu Technologies Limited. "User" refers to any person registered to use the Blu platform. "BluBike" means any electric bicycle owned or operated by Blu. "Ride" begins when a BluBike is unlocked and ends when it is properly parked and locked through the Blu application.

2. Eligibility

Users must be at least 18 years old or have the approval of a parent or guardian, provide accurate registration details, possess a valid Nigerian phone number, valid means of identification and a valid payment method. Blu reserves the right to refuse, suspend or terminate any account.

3. User Accounts

Users are responsible for maintaining the confidentiality of their account credentials and for every ride made through their account. False information or unauthorised use may result in immediate suspension or termination.

4. Wallet, Payments and Ride Charges

Users must maintain at least the minimum wallet balance shown in the Blu application before commencing a ride.

Ride charges are calculated at the rates displayed in the Blu application, and consist of:

  • a distance fee, charged at the start of every kilometre ridden. Unlocking a BluBike attracts no distance fee on its own — a bicycle that is not moved is never charged one;
  • a holding fee, charged for each complete holding period during which the bicycle is kept without moving. A holding period that is begun but not completed is not charged.

Distance travelled and holding time are measured from the location data recorded while your ride is in progress. Charges end only when the bicycle has been properly parked, locked, and the ride has been successfully ended through the Blu application. Every ride is also subject to the maximum single-ride charge shown in the application.

The current rates, the minimum balance and the maximum charge are displayed in the Blu application and may be revised by Blu at any time. The rates shown when you unlock a BluBike are the rates that apply to that ride; a change made while a ride is in progress does not affect it.

5. Proper Use of BluBikes

Users shall ride responsibly, inspect the bicycle before use, obey all applicable laws, and use the bicycle solely for personal transportation.

Users shall not:

  • carry more than one rider;
  • ride while under the influence of alcohol or drugs;
  • perform stunts or races;
  • tamper with the battery, GPS, lock, wiring or any component of the bicycle;
  • intentionally damage Blu property;
  • use the bicycle for any unlawful purpose.

6. Parking and End of Ride

At the end of every ride, users must:

  • park the BluBike in an authorised Blu parking location or designated street location;
  • park neatly without obstructing roads, gates, entrances, walkways or emergency access;
  • properly lock the bicycle and end the ride through the Blu application;
  • not keep the bicycle in their possession after the ride has ended or store it inside homes, compounds, offices, garages, or any private property.

Improper parking or failure to return the bicycle may attract additional charges.

7. Operating Area Restrictions

BluBikes are intended for use only within Blu's approved operating area. Users shall not remove, ride or transport any BluBike outside the estate or designated service area without Blu's prior written approval. Any violation may result in account suspension, recovery costs, and other applicable charges.

8. User Responsibilities

Users are responsible for all traffic violations, fines, penalties, losses or damages arising from their use of a BluBike and shall exercise reasonable care while riding.

9. Accidents, Damage and Theft

Users must immediately report any accident, theft, attempted theft, vandalism or damage involving a BluBike. Users may be liable for repair or replacement costs where loss or damage results from negligence, misuse or intentional misconduct.

10. GPS and Battery

Every BluBike is equipped with GPS tracking technology. By using the Service, users consent to the collection of ride and location information for operational, security and legal purposes. Users shall not remove, disconnect or interfere with the battery, GPS tracker or any electrical component.

11. Availability of Service

Blu does not guarantee uninterrupted availability of the Services. The Services may be unavailable due to maintenance, network issues, weather conditions, power outages, force majeure or circumstances beyond Blu's reasonable control.

12. Prohibited Conduct

Users shall not engage in fraud, abuse Blu staff, interfere with Blu's systems, create fraudulent accounts or misuse the Services. Violations may result in suspension, permanent termination and legal action where appropriate.

13. Suspension and Termination

Blu may suspend or terminate any account for breach of these Terms, fraudulent activity, damage to Blu property, non-payment of fees or any conduct that threatens Blu, its staff or other users.

14. Limitation of Liability

Cycling carries inherent risks. To the fullest extent permitted by law, Blu shall not be liable for injuries, loss of personal property, indirect or consequential damages, service interruptions or weather-related incidents except where liability cannot lawfully be excluded.

15. Indemnity

Users agree to indemnify and hold Blu harmless against any claims, losses, liabilities, damages or expenses arising from their misuse of the Services or breach of these Terms.

16. Privacy

Blu collects personal information including user identification details, payment information, ride history and GPS location data to provide and improve its Services. Such information will be processed in accordance with applicable Nigerian data protection laws.

17. Intellectual Property

All Blu trademarks, logos, software, designs and other intellectual property remain the exclusive property of Blu and may not be copied, reproduced or used without prior written permission.

18. Amendments

Blu may amend these Terms from time to time. Continued use of the Services after any amendment constitutes acceptance of the revised Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute shall first be resolved through Alternative Dispute Resolution (ADR), including mediation, before court proceedings are commenced where applicable.

By registering an account, funding your wallet, unlocking or riding a BluBike, you confirm that you have read, understood and agree to be bound by these Terms and Conditions.
